Effective date: November 1, 2026
These Terms & Services ("Terms") govern your access to upbeatcars.com and your enrollment in vehicle service contracts, mechanical breakdown protection, and related optional benefits marketed by Upbeat Cars ("Upbeat Cars," "we," "us," or "our"). By using the website, submitting a form, or purchasing a plan, you agree to these Terms and to the administrator policies incorporated by reference in your contract.
Upbeat Cars markets vehicle service contracts and related protection products that are administered by licensed third-party administrators and insurers. Unless expressly labeled otherwise, products are not manufacturer warranties and do not replace recalls, factory campaigns, or maintenance required by the vehicle maker. Coverage, exclusions, waiting periods, deductibles, and claim limits are defined solely in your signed contract and schedule of benefits.
You represent that information supplied during quoting and enrollment is accurate, including vehicle identification number, odometer reading, usage type, and modification status. Misrepresentation may void coverage or result in claim denial. Vehicles used for racing, off-road competition, or unauthorized commercial activity may require endorsements; failure to obtain endorsements makes related claims ineligible.
Most plans include waiting periods and mandatory maintenance intervals. You agree to retain receipts for oil changes, filter services, and inspections specified in your contract. Wear items such as brakes, tires, wiper blades, and clutch friction materials are excluded unless your schedule explicitly lists them.
Before authorizing repair on a covered failure, you must obtain pre-authorization from the claims administrator unless emergency roadside assistance applies. Unauthorized repairs may not be reimbursed. You agree to allow inspection of the vehicle and failed parts, and to cooperate with reasonable requests for diagnostic evidence.
Installment plans may include finance charges disclosed at checkout. Late payments can suspend coverage until accounts are current. Cancellation rights, refund calculations, and transfer fees follow your contract and applicable regulations. Upbeat Cars does not guarantee refund amounts in marketing materials; only contract formulas control.
You may not scrape, reverse engineer, or misuse website content. Estimators and quote tools provide illustrative figures—not binding offers. We may modify site features without notice. Links to third-party repair or payment sites are provided for convenience; we are not responsible for their content or security practices.
Services are provided "as is" to the fullest extent permitted by law. We disclaim implied warranties regarding uninterrupted website access. Nothing in these Terms expands coverage beyond your contract.
To the maximum extent allowed, Upbeat Cars is not liable for indirect, incidental, or consequential damages arising from site use or enrollment errors. Our aggregate liability for website-related claims shall not exceed the fees you paid to Upbeat Cars for marketing services in the twelve months preceding the claim.
Disputes relating to these Terms or website use shall be resolved through binding arbitration on an individual basis, except where prohibited. You waive class actions to the extent permitted. Contract disputes about covered repairs are governed by the dispute section of your vehicle service contract.
We may update these Terms by posting a revised version with a new effective date. Continued use of the website after changes constitutes acceptance. Material contract changes require administrator notice as specified in your plan documents.
Unless your schedule of benefits expressly states otherwise, the following are excluded: pre-existing conditions known before enrollment, damage from accident or collision, corrosion, environmental contamination, improper repairs, aftermarket modifications not disclosed at enrollment, and failures caused by neglected maintenance. Consequential loss—including lost wages, lodging, or business income—is excluded except where a trip interruption or rental benefit is purchased and approved.
Coverage terminates upon declaration of total loss, salvage branding, or odometer rollback findings. You must notify us within ten days of any title branding event. Disputed mileage readings may require third-party inspection at your expense if records are incomplete.
Plans may be transferable to subsequent owners for a disclosed fee. Transfers require submission within the window specified in your contract, proof of sale, and current odometer certification. Failure to complete transfer steps leaves the new owner without coverage.
Illustrations on upbeatcars.com—including payment estimators, sample deductibles, and component lists—are summaries only. If a summary conflicts with your executed contract, the contract controls. Verbal statements by third-party marketers not authorized in writing do not amend your plan.
All trademarks, logos, guides, and downloadable content on this site are owned by Upbeat Cars or licensors. You may print contract documents for personal use but may not reproduce site content for commercial redistribution without permission.
You agree to indemnify Upbeat Cars against claims arising from your misuse of the website, submission of fraudulent claim documentation, or violation of these Terms, except to the extent caused by our gross negligence.
We are not responsible for delays caused by events outside reasonable control, including natural disasters, widespread network outages, administrator system failures, or repair supply chain disruptions. We will use commercially reasonable efforts to restore services and communicate delays.
If any provision of these Terms is unenforceable, the remaining provisions remain in effect. These Terms, together with your signed vehicle service contract and privacy policy, constitute the entire agreement regarding website use.
